Terms of service

Plain-English summary

By using Merkle Tree Affiliates you agree to (a) promote campaigns honestly, (b) not send bot, incentivised, or fraudulent traffic, (c) follow each advertiser's specific terms, and (d) let us review and adjust commissions tied to fraudulent or refunded conversions inside the holding period. We agree to (i) track every click + conversion accurately, (ii) pay you on time per the published cadence, (iii) be transparent about why a conversion was rejected, and (iv) provide a real human to talk to.

1. Eligibility

You must be 18+ and legally able to enter contracts. US affiliates must provide a valid W-9 before the first payout exceeding the IRS threshold.

2. Application + approval

Apply via /apply. We review every application manually. We may reject or revoke approval at our discretion if traffic quality, brand fit, or compliance posture changes.

3. Traffic rules

  • No bot, incentivised, or otherwise fraudulent traffic.
  • No cookie stuffing, iframe stuffing, or auto-redirect tricks.
  • No brand-bidding on advertiser trademarks unless explicitly allowed.
  • No misrepresentation of the offer or its terms in your creatives.
  • Follow the advertiser's specific creative + content rules listed on each campaign.

Violations trigger pause, clawback, and possible termination.

4. Tracking + attribution

Last-click within the cookie window (default 30 days, set per-campaign) wins. Click-IDs returned via S2S postback override cookie attribution when present. We publish our attribution rules — see the help center.

5. Commissions + holding period

Conversions start in pending and move to available after the campaign-specific holding period (default 14 days). During the holding period advertisers may reject or refund a conversion — those commissions are clawed back. After the holding period commissions are final.

6. Payouts

We pay on the published cadence (default Net-7) once your balance is at or above your threshold and you have a valid payment method on file. Gas fees on crypto disbursements are deducted at cost.

7. Fraud scoring

Every click is scored 0–100 by our risk engine. Clicks scoring 80 or higher are auto-quarantined and won't credit conversions until released. We'll tell you the reason. You can dispute — we'll review.

8. Account termination

Either party may terminate with notice. We retain the right to suspend immediately for fraud, ToS violation, or lawful order. Earned but unpaid commissions at the time of termination are paid on the next regular cycle unless tied to a fraud investigation.

9. Intellectual property

Advertiser creatives and trademarks remain the property of the advertiser. You get a non-exclusive license to use them solely to promote their offers via the network.

10. Disclaimers + liability

The service is provided "as is." We don't guarantee earnings. Our maximum aggregate liability is the commissions earned by you over the prior 12 months. We're not liable for indirect or consequential damages.

11. Governing law

These terms are governed by the laws of the State of Delaware, USA. Disputes are resolved in the state and federal courts in Delaware.
